Data Recovery - Terms and Conditions

1. Authorization
   The client authorizes Couri Tech to evaluate of the media sent to determine the nature of the damage and provide an estimate of recovery cost and timing. There is an associated "diagnostics fee" of $40 (US) and no other recovery efforts work beyond this evaluation will be charged without explicit client approval. The amount of time allotted for the diagnostics fee (only) will not exceed 20 minutes, and in no event does Couri Tech warrant that recovery of any data is guaranteed to occur.
2. Manufacturer Warranty
   The client agrees that during the process of data recovery at Couri Tech it will not be necessary to break the seals on the media, thereby voiding the manufacturers warranty and voiding the possibility of a "clean room" recovery method made by a manufacturers drive repair facility.
3. Legal Rights
   The client, by acknowledgement agrees to (and warrants to Couri Tech and all its employees) that any drive recovery attempts or data retrieval is hereby requested to be performed (and further) acknowledges to Couri Tech that the customer is also the legal owner, (and/or) designated and responsible owner of data contained on the hard drive on which recovery attempt is being requested. Any property left with Couri Tech unclaimed for 30 days, will be disposed of. At which time, Couri Tech shall have no liability to the client or any third party.
4. Confidentiality
   Couri Tech agrees not to disclose any and all information or data files supplied with, stored on, or recovered from client equipment except to employees subject to confidentiality agreements or as required by law.
   
   Couri Tech endeavors to take all reasonable precautions to protect the condition and confidentiality of your data while in our possession.
5. Payment
   Payment of the "Diagnostics fee" is due in full at the time of drop off, and this fee is non-refundable. Any and all other fees associated with recovery attempts are due in full upon completion of recovery, prior to the release of data or hardware to client.
   Purchaser acknowledges that all fees relating to data recovery "post recovery" services are performed are final, no refund will be permitted under any circumstances.
   The client is financially responsible for all shipping costs, custom duties and taxes to and from Couri Tech
   We accept VISA, Master-Card, and wire transfers.
    
6. Warranty
   Couri Tech makes no warranty, express or implied, and Couri Tech disclaims any warranty of any kind, including any warranty of merchantability or fitness for a particular purpose.
7. Agreement
   This Agreement shall be governed in all respects by and construed in accordance with the laws of the State of Maryland, without respect to its "conflict of law" rules.

Limited Liability
Couri Tech shall not be liable for any claims regarding the physical functioning of equipment/media or the condition or existence of data on storage media supplied before, during or after service.

In no event will Couri Tech be liable for any loss of data or loss of revenue or profits or any special, incidental, contingent, or consequential damages, however caused, before, during or after service even if Couri Tech has been advised of the possibility of damages or loss to persons or property. Couri Tech liability of any kind with respect to the services, including any negligence on its part, shall be limited to the contract price for the services.
Client and Couri Tech agree that the sole and exclusive remedy for unsatisfactory work or data shall be, at Couri Tech's option, be limited in liability to make further attempts by Couri Tech only to recover satisfactory data (or) Couri Tech agrees to refund of the amount pre-paid by the client "only". The signing parties acknowledge and agree that the price of Couri Tech services would be much greater if Couri Tech undertook more extensive liability.

Client is aware of the inherent risks of injury and property damage involved in data recovery, including without limitation, risks due to destruction or damage to the media or data and inability to recover data, or inaccurate or incomplete data recovery, including those that may result from the negligence of Couri Tech, and assumes any and all known risks of injury and property damage that may results.
